Who you are dealing with
Spotless is made by Anthony Kroeger, a sole trader in Australia ("we", "us"). Purchases are sold by Stripe through Link as the merchant of record, under Stripe's terms of sale. These terms cover your use of the Spotless software.
Trial
You can use Spotless free for 14 days. After the trial, you need a license to keep using it.
Your license
- When you buy Spotless, you get a personal, non-exclusive, non-transferable license to use it on the number of Macs stated at the time of purchase.
- The license does not expire. It covers the version you buy and the updates we release for it.
- Do not share, resell, or publish your license key, and do not try to get around the license checks.
- We may disable a license that was refunded, charged back, or obtained or used in breach of these terms.
Your Gmail account
Spotless works with your Google account through Google's official APIs. You remain bound by Google's terms for your account. Spotless acts only on your instructions, for example when you mark a conversation done or send a reply. How Spotless handles your data is described in the privacy policy.
Acceptable use
Do not use Spotless to send spam, to break the law, or to break Google's terms. Do not reverse engineer, modify, or redistribute the app, except where the law allows it.
Refunds
Spotless has a free 14-day trial, so you can try every feature before you buy. We do not give refunds if you change your mind after you buy, except where the law where you live gives you a right to cancel. For example, consumers in the EU and the UK can have a 14-day right to withdraw from a purchase. Stripe, as the merchant of record, handles these requests and may also refund a purchase in some cases, for example to prevent a dispute. None of this affects your consumer rights, described below.
Your consumer rights
Many countries give consumers rights that a business cannot take away. Nothing in these terms excludes, restricts, or changes any right or remedy you have under the law of the country where you live that cannot be excluded.
Australia. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. If Spotless has a major failure, you are entitled to a refund.
EU, UK, and other countries. You keep the rights that the consumer laws of your country give you, for example rights when digital content is faulty or not as described.
Limits on our responsibility
To the extent the law allows, Spotless is provided "as is". Email is important, so we build Spotless carefully: it cannot permanently delete mail, and your mail stays in your Gmail account. Still, we are not liable for indirect or consequential loss, and, to the extent the law allows, our total liability to you is limited to the amount you paid for Spotless. Some countries do not allow some of these limits, so they may not apply to you.
Changes and ending
We may update these terms. If a change is significant, we will tell you before it applies. You can stop using Spotless at any time. We may end your license if you seriously break these terms.
Law
These terms are governed by the laws in force in New South Wales, Australia. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts of that country.
